I was contacted by this law firm as counsel for my apartment complex in connection with a domestic-violence–related lease termination. I did not seek out or retain this firm for representation. The communication I received did not clearly reflect Arizona’s statutory protections for domestic violence survivors, including that a tenant is not required to sign a settlement agreement, release of claims, or waive civil or fair housing rights in order to terminate a lease pursuant to A.R.S. § 33-1318. Given the seriousness of domestic violence–related housing matters, accuracy and clarity around survivor protections are critical. Tenants in similar situations should be aware of their statutory rights and ensure those rights are not conditioned on unnecessary or overreaching agreements.
